Delta County Records and the Law
Booking reports in Colorado are public records. The Criminal Justice Records Act, C.R.S. 24-72-301, requires records of official actions to be open for inspection. An arrest is an official action. The Delta County Sheriff's Office must make booking reports available when someone requests them.
Under C.R.S. 24-72-302, arrest records include the person's name and date of birth, the identity of the arresting agency, the date and place of the arrest, and the charges. Those are the core pieces of a Delta County booking report. The law gives the sheriff 3 working days to respond to a request. An extension of up to 7 more days is allowed for complex requests.

Booking Photos and Record Sealing
Booking photos from Delta County are public records. You can request them from the sheriff. But C.R.S. 24-72-305.5 makes it illegal to post mugshots online and charge a fee for their removal. Violating that law is a misdemeanor with fines up to $1,000.
Colorado also allows arrest records to be sealed. The CBI seals records automatically when no charges are filed within a year, for arrests after January 1, 2022.
